Value-Based Arrangement Request for Provider Feedback

SB0834/Ch. 298, HB 1148/Ch. 297(2), 2022 - Health Insurance – Two–Sided Incentive Arrangements and Capitated Payments – Authorization requires the Maryland Health Care Commission (MHCC) to aggregate the (1) the number and type of value–based arrangements entered into in accordance with the authority established under the law; (2) quality outcomes of the value–based arrangements; (3) the number of complaints made regarding value–based arrangements; (4) the cost–effectiveness of the value–based arrangements; and (5) the impact of two–sided incentive arrangements on the fee schedules of health care practitioners included in the target budget that are not eligible providers.

In addition to meeting these requirements, MHCC is interested in seeking provider feedback on value-based arrangements in the commercial fully-insured market.  

Provider Feedback

Provider feedback should be shared via email or this form. Providers submitting  feedback should submit their answers in numbered response to the questions.  Please see attached.

Uncompensated Care Claims

The MHCC is excited to announce that SCAS Management Group, LLC (SMG) has been selected as our new third-party administrator (TPA) responsible for adjudicating Trauma Fund claims. Founded in 2011 and based in Milwaukee, Wisconsin, SMG specializes in providing administrative services to both government and private payers. We look forward to a long and successful partnership with SMG, working together to provide exceptional customer service to our Trauma Fund providers. Claims processing is expected to resume around April 1, 2025, and additional information will be shared in March.

Non-CDS Reporting

State law (Health General Article §19-145) requires licensed dispensers (including pharmacists and health care practitioners authorized to dispense prescription drugs in the State) to electronically submit noncontrolled prescription drug (non-CDS) dispense information to the State-Designated Health Information Exchange (CRISP). Dispenser reporting is required by September 1, 2025 (COMAR 10.25.18.13). For more information, visit MHCC’s dedicated non-CDS webpage.

Dispenser Manual

Technical guidance for reporting non-CDS dispense information is included in the Noncontrolled Prescription Drug Dispenser Data Submission Manual (approved at the June 12, 2025 meeting of the Commission). A multi-stakeholder approach guided iterative development of the dispenser manual.

Waiver Requests

COMAR 10.25.18.13, Noncontrolled Prescription Drugs Dispenser Reporting (Section F) allows dispensers who meet certain conditions to request a time-limited waiver from non-CDS reporting. A waiver request form is available here and must be completed for MHCC’s consideration.
